BISMARCK, N.D. (KFGO) – North Dakota consumers who purchased certain generic prescription drugs over a 10-year period may be eligible for financial compensation following a $96.5 million multi-state settlement, Attorney General Drew Wrigley announced.
The claims process is now open after a federal judge in Connecticut granted preliminary approval for a distribution plan filed by Wrigley and a coalition of 47 other attorneys general. The settlement resolves allegations that major pharmaceutical companies illegally conspired to inflate generic medication prices, discourages competition, and overcharges consumers.
The funds stem from settlements with several manufacturers, including Glenmark, Lannett, Bausch, Apotex, and Heritage Pharmaceuticals. Investigators uncovered evidence of widespread collusion among corporate executives who routinely communicated to set prices and divide market share.
“We are committed to returning money to North Dakotans who paid more than they should have for these drugs,” Wrigley said. “I encourage everyone to review the criteria, determine whether you qualify, and, if you do, submit a claim.”
The settlement applies to eligible generic drugs purchased between May 2009 and December 2019. A list of the affected drugs is found here.
The nationwide lawsuit is part of a broader series of ongoing antitrust cases targeting dozens of corporate defendants and drug executives across the industry.
