BISMARCK, N.D. – The North Dakota Supreme Court has denied the latest appeal of a Gardner man convicted in the 2001 murder and dismembering of Timothy Wicks.
Dennis Gaede was sentenced in 2006 to life in prison without parole.
In the ruling released this week the state’s high court dismissed the petition for post-conviction relief saying Gaede’s claim was filed outside the statute of limitations.
In addition, the justices supported a district court ruling that a PTSD diagnosis was not newly discovered evidence.
